Terms of Service

Last updated: [DATE]

Structure only. Operative text is drafted by Legal. The descriptions of how the service behaves are accurate and are provided as input. They are not a substitute for the agreement.

1. The agreement

[PARTIES, ACCEPTANCE, ORDER OF PRECEDENCE WITH ANY ORDER FORM]

2. The service

The service evaluates whether an email address can receive mail and returns a status, a recommended action and the reason codes behind both. It does not deliver messages, and it does not represent that a deliverable result guarantees delivery: acceptance by a mail server is evidence, not proof. A confirmation message remains the only thing that proves control of a mailbox.

3. Accounts and credentials

Access is authenticated. Credentials are issued per integration and may be rotated or revoked individually. You are responsible for keeping them server-side and for activity carried out with them. [FURTHER TERMS]

4. Acceptable use

Verification exists to protect delivery and data quality. It may not be used to enumerate mailboxes at a domain, to build or enrich lists of addresses you have no relationship with, or to support unsolicited messaging. Request volume is bounded per caller and per source network, and patterns consistent with enumeration are treated as abuse regardless of volume. [ENFORCEMENT AND CONSEQUENCES]

5. Credits and payment

[CREDIT DEFINITION, EXPIRY, MINIMUM PURCHASE, BILLING, REFUNDS, TAX]

6. Data protection

Processing of personal data is described in the privacy policy and governed by the data processing agreement where one applies.

7. Availability

[SERVICE LEVELS, MAINTENANCE, CREDITS FOR MISSED TARGETS]

8. Warranties and liability

[WARRANTIES, DISCLAIMERS, LIABILITY CAPS, INDEMNITIES]

9. Term and termination

[TERM, TERMINATION RIGHTS, EFFECT ON UNUSED CREDITS AND STORED DATA]

10. Changes

[HOW CHANGES ARE MADE AND NOTIFIED]

11. Governing law

[JURISDICTION AND DISPUTE RESOLUTION]
